- Governing policy
These procedures relate to the Terms and Conditions of Enrolment and outline how the Institution implements an Institution-initiated suspension or cancellation of enrolment in accordance with the Terms and Conditions of Enrolment and related policies and procedures.
These procedures are aligned with the relevant Australian Government legislation including the Education Services for Overseas Students Act 2000 (ESOS Act) and National Code of Practice for Providers of Education and Training of Overseas Students 2018 (National Code), including Standard 9.
- Scope
These procedures apply to all students whose enrolment is subject to an Institution-initiated suspension or cancellation of enrolment and to staff involved in administering, assessing, recording, and reporting such actions. Student-initiated changes to enrolment status, including temporary leave of absence or permanent withdrawal are outlined in the Leave of Absence Procedures and Withdrawal Procedures respectively.
- Procedures
3.1. These procedures set out the three key processes involved in managing Institution-initiated suspension or cancellation of enrolment, as outlined in Table 1:
- Institution initiates a suspension or cancellation of enrolment
The Institution reserves the right to suspend or cancel a student’s enrolment and issue the student with a Notice of Intention to Suspend or Cancel Enrolment outlining the reason(s) for the proposed action and the applicable response options.
- Finalising suspension or cancellation of enrolment
Where a decision to suspend or cancel enrolment is determined by the Institution, it issues a final notice of suspension or cancellation of enrolment to the student. For international students the notice includes information regarding the Institution’s obligation to report the change in enrolment status to the Department of Home Affairs (DHA) in accordance with the National Code.
- Recording/reporting
The student’s enrolment status is updated in the Institution’s student management system, and where applicable, reporting is completed in PRISMS for international students.

| 1.1 The Institution reserves the right to suspend or cancel a student’s enrolment for the following reasons, including (but not limited to):
a. An offer of admission was made on the basis of incomplete, incorrect, fraudulent or misleading information provided by the applicant, international representative (e.g., education agent), delegated authority or certifying body in accordance with the Admissions Policy; b. A breach of the Terms and Conditions of Enrolment, including (but not limited to) failure to pay tuition fees or other fees or charges owed to the Institution; c. A substantiated allegation that the student has engaged general misconduct in accordance with the General Misconduct Policy and/or Student Code of Conduct and General Misconduct Procedures); d. A breach of course progress or attendance requirements in accordance with the Academic Progression Policy, ELICOS Course Progression and Attendance Policy (attendance requirements relate to ELICOS and Foundation only); e. A breach of academic integrity in accordance with the Academic Integrity Policy, Academic Integrity Procedures and Artificial intelligence Policy). f. a student has abandoned their studies meaning that they have ceased to engage in their course of study and failed to resume enrolment, participate in required academic activities or formally apply for leave of absence or withdrawal within the required timeframe, indicating an intention not to continue their studies. 1.2 Table 2 provides a detailed summary of the reasons and timeframes for suspension and cancellation. 1.3 Where, in accordance with the relevant policy or procedures, the Institution determines that a student’s enrolment is to be suspended or cancelled, the student is issued with a notice of intention to suspend or cancel enrolment. For international students, the notice advises that the Institution is required to report the outcome to the DHA (known as Intention to Report). 1.4 The notice of Intention to Report includes the following information: a. The reasons for suspension or cancellation of enrolment; b. The period of the suspension and the conditions for return to study, if applicable; c. Information about the student’s right to access the Complaints and Appeals Policy and Complaints and Appeals Procedure including a period of 20 business days to lodge a complaint; d. For international students, advice on the potential impact on their student visa. 1.5 Students who have had their enrolment cancelled are permitted to re-apply for admission to the Institution in the following circumstances only (and upon satisfying timeframes for suspension and/or cancellation and other any conditions outlined in Table 2): a. all outstanding fees have been paid in full; b. the student has satisfied all conditions imposed as a result of breaches of course progress or attendance requirements in accordance with the relevant policy or procedures). In exceptional circumstances, the Registrar may approve readmission where the student demonstrates academic success at another provider during the exclusion period; c. the student has satisfied all conditions imposed by the Institution as a result of a breach of the Academic Integrity Policy, the Student Code of Conduct, the General Misconduct Policy or the Terms of Conditions of Enrolment. d. a student who abandoned their studies and wishes to re-apply for admission into a course. 1.6 At its discretion, the Institution may refuse a student readmission into course. This is normally outlined in a student’s notification of cancellation. |

| Step 2 Finalising suspension or cancellation of enrolment | ||
| All students
2.1 The Institution only proceeds with imposing a suspension or cancellation of enrolment after one or more of the following has occurred: a. the 20 business-day internal complaints and appeals periods have expired and no complaint or appeal was submitted b. The student has withdrawn, in writing, from the internal complaints and appeals processes; or c. The student’s internal complaint, and any subsequent appeal, was unsuccessful; unless d. The health or wellbeing of an international student, or the wellbeing of others, is considered to be at risk in which case the Institution may proceed immediately. Additional requirements for international students 2.2 if cancellation of enrolment is due to unsatisfactory course progression the Institution proceeds only after: a. paragraph 2.1(a) has occurred; or b. both the internal and external complaints and appeals processes have been completed, and the decision supports the Institution; or c. the student has chosen not to access the external complaints process via the National Student Ombudsman; or d. the student has withdrawn in writing from the internal or external complaints and appeals processes. 2.3. If the cancellation of enrolment is due to non-payment of fees or misconduct, the Institution proceeds only after: a. 2.1(a) has occurred; b. the internal complaints and appeals process has been completed, and the decision supports the Institution; or c. the student has withdrawn in writing from the internal complaints and appeals process. 2.4 Once a decision is finalised, the Institution issues the students with a final notice of suspension or cancellation of enrolment which includes: a. for suspensions, the period of suspension (see Table 2) and details relating to returning to study after the suspension; b. for international students, notification of the Institution’s obligation to report the change in enrolment status to the DHA including advice that the student’s CoE will be cancelled and that the student is required to contact DHA within 28 days. 2.5 The period of suspension is determined by the Institution in accordance with Table 2. |

| Step 3 Recording and reporting | ||
| 3.1 To finalise an Institution-initiated suspension or cancellation of enrolment, Student Services updates the student management system to accurately reflect the student’s enrolment status.
3.2 For international students, the student’s CoE is reported in PRISMS within the following timeframes: a. 31 days after the conditions outlined in paragraphs 2.1-2.3 have been met; or b. 14 days after the conditions outlined in paragraphs 2.1-2.3 have been met for students under 18 years of age. 3.3 Suspension of enrolment and cancellation of enrolment actions are reported in PRISMS via the Student Course Variation (SCV) function, in accordance with the PRISMS User Guide. 3.4 Where a CoE is cancelled, the Institution notifies the international student in writing that the cancellation has been reported to the DHA. The notification advises the student to contact the DHA to discuss the potential impact on their student visa. |

Students returning to their studies following a period of suspension are placed on probation for up to two study periods and monitored by the Chief Operations Officer (or their delegate). During this probationary period, students must demonstrate the expected standard of behaviour outlined in the Student Code of Conduct and comply with all institutional policies and procedures. If a student fails to meet these expectations or breaches any policies, they will be promptly referred to the General Misconduct Panel for further review. This review may result in an additional period of suspension or the cancellation of enrolment if deemed necessary. - Records management
As outlined in Table 1, all Institution-initiated suspensions or cancellations of enrolment are recorded in the Institution’s student management system. Where applicable, statutory reporting is completed in PRISMS. All records are retained for two years after the student ceases to be an accepted student in accordance with the Records Management and Personal Information Procedures.
